Your Presale Developer Missed the Completion Date. Now What?
What actually happens when a presale is delayed? Learn about outside dates, deposit protection, and financing risk before you sign a presale contract.
Presale delays are common enough right now that anyone signing a presale contract in Vancouver should understand exactly what protections they have, and what they don't, before completion day arrives.
The "Outside Date" Is Your Real Deadline
Every presale contract includes an "outside date," the absolute latest date the developer can complete the project before you're entitled to walk away and get your deposit back. This is different from the "estimated completion date" marketed to you when you bought. Developers routinely push completion within that estimated window; it's the outside date that actually protects you.
Read this clause carefully before you sign. Some outside dates are years past the marketed completion date, giving developers a lot of room to delay without any consequence to them.
Where's Your Deposit During All This?
Your deposit should be held in a trust account, separate from the developer's operating funds, and only released once specific conditions are met. This is meant to protect your money if the project stalls or the developer runs into financial trouble. Confirm this trust arrangement is in place and ask your lawyer to verify it, don't just take it on faith from the sales centre.
The Hidden Risk: Re-Qualifying for Your Mortgage
Here's the part buyers often miss. Your mortgage pre-approval was based on the rates and your finances at the time you signed, often years before completion. If the project is delayed, you may have to re-qualify for financing under whatever rates and lending rules exist when it finally completes, not the ones you originally planned around. If your financial situation or the rate environment has changed, this can be a real problem.
What To Do About It
Before signing a presale contract:
Find and understand the outside date, not just the marketed timeline.
Confirm your deposit is held in a proper trust arrangement.
Ask your mortgage broker how a multi-year delay could affect your ability to qualify at completion.
A presale can be a great option, but only if you go in understanding these mechanics rather than assuming the timeline you were sold is the timeline you'll get.
